Terms of Service
Effective date: May 26, 2026
These Terms of Service ("Terms") govern your use of the Arch mobile application (the "Service"). "Arch," "we," and "us" refer to the operator of the Service, with a mailing address of 2 Pond Road, Rumson, NJ 07760. By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
These Terms include a mandatory arbitration agreement and class- action waiver in Section 14. Please read carefully.
1. Eligibility
To use Arch you must:
- Be at least 18 years of age.
- Be a current undergraduate or graduate student at an accredited US
college or university with a working
.eduemail address. - Not be barred from using the Service under applicable law.
- Not have previously had your Arch account suspended or terminated for violating these Terms.
You represent and warrant that the above are true each time you use the Service.
2. Your account
2.1 Registration
You must register with a working .edu email address and provide
accurate information, including your real first and last name and a
real date of birth. Impersonation and false identity are grounds for
immediate termination.
2.2 Account security
You are responsible for safeguarding your access to Arch and for any activity that occurs under your account. Notify us at support@arch.college immediately if you suspect unauthorized access.
2.3 One account per person
You may not maintain more than one Arch account at a time.
3. What you can do on Arch
Arch lets you:
- Discover and RSVP to events hosted by other students at your campus and nearby selected campuses.
- Host your own events, including ticketed events.
- Connect 1-on-1 with other students for friendship.
- Send direct messages once you and another user have mutually connected.
- Build a profile that is shown to other students.
4. Code of conduct
You agree not to:
- Lie or impersonate. Use a name, photo, age, school, or any other profile data that is not genuinely yours.
- Use Arch as a minor or recruit minors. Arch is for adults only. Do not invite, contact, or accept connections involving anyone under 18.
- Harass, threaten, or harm. No bullying, threats, harassment, stalking, hate speech, doxxing, or non-consensual content of any kind.
- Post illegal content. No content that is unlawful, infringes intellectual property, depicts minors in any sexualized context, or promotes self-harm, violence, or terrorism.
- Use Arch to date. Arch is a friend-and-event platform. Do not use the Service to pursue romantic or sexual relationships, solicit sex, or post sexually explicit content. We reserve the right to remove content and accounts at our sole discretion.
- Sell, scam, or spam. No commercial solicitation, multi-level marketing, scams, phishing, or unsolicited bulk messages.
- Resell or scalp tickets. Tickets you obtain through Arch are for your personal attendance only. Reselling for profit is prohibited.
- Reverse-engineer, scrape, or attack. No automated scraping, no load-testing without permission, no attempts to bypass technical measures, no malware, no probing for vulnerabilities outside an explicit responsible-disclosure program.
- Misuse safety tools. No abusive use of the reporting feature to retaliate against another user.
- Violate other people's privacy. Don't share private information about another user without their consent.
Violation of any of the above may result in immediate removal of content, suspension, or termination of your account, and may be referred to law enforcement.
5. Content
5.1 Your content
You retain ownership of content you post on Arch (your profile, your events, your photos, your messages, your prompts). By posting content you grant Arch a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, modify (e.g., resize images for delivery), display, and distribute that content solely to operate and improve the Service.
You represent that you have the rights to post the content you upload.
5.2 Our content
The Arch app, name, logo, and all related branding are the property of Arch. You may not copy, modify, or use them without our prior written permission.
5.3 Removal
We may remove content that violates these Terms or that we reasonably believe creates legal risk to Arch or its users, without prior notice.
6. Events and tickets
6.1 Hosting events
When you host an event you are solely responsible for:
- The accuracy of the event description, location, and time.
- Compliance with all applicable laws, including any required permits, alcohol service rules, or venue agreements.
- The safety of attendees and the conduct of the event itself.
Arch is a publishing platform; we are not the host or organizer of any event posted on the Service.
6.2 Paid tickets
If you sell tickets through Arch:
- Payments are processed by Stripe, and you must complete Stripe's onboarding (including providing tax information).
- Arch collects a 1% platform fee on the gross ticket price; Stripe charges its own processing fee (approximately 2.9% + $0.30 per transaction). Both are deducted before payout.
- Refunds: a buyer is always entitled to a full refund within one (1) hour of purchase. Beyond that, you choose your own refund policy when creating the event. If you cancel the event, all paid attendees receive a full refund.
- Chargebacks and disputes are your responsibility. Arch is not a party to the contract of sale between you and the attendee.
6.3 Attending events
When you attend an event posted on Arch, you do so at your own risk. Arch does not endorse, vet, or insure events or hosts. Exercise the same caution you would when meeting anyone from the internet in person.
7. Direct messages
Direct messages between matched users are not end-to-end encrypted. Arch staff may access messages when responding to a report, complying with legal process, or investigating a violation of these Terms.
8. Subscription (Arch Plus)
Arch Plus is an optional paid subscription ($1.00 per month). Subscriptions auto-renew until cancelled. Manage or cancel your subscription through Apple's App Store (in-app or in Settings → [your name] → Subscriptions). Refunds for subscription charges are governed by Apple's policies; Arch cannot issue Apple subscription refunds directly.
9. Reporting and moderation
If you encounter content or behavior that violates these Terms, please report it using the in-app report feature or by emailing support@arch.college. We review reports promptly. We are not obligated to act on every report and our moderation decisions are final.
10. Termination
10.1 By you
You may delete your account at any time via Profile → Account → Delete account or by emailing support@arch.college.
10.2 By us
We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms or created risk for Arch or its users. We may also discontinue the Service entirely with reasonable advance notice.
10.3 Effect of termination
On termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive will survive (including Sections 5.1, 6.2, 11, 12, 13, 14, and 15).
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, Arch DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS.
WE DO NOT VERIFY THE IDENTITY OR BACKGROUND OF USERS BEYOND .EDU
EMAIL VERIFICATION AND DATE-OF-BIRTH SELF-ATTESTATION. YOU INTERACT
WITH OTHER USERS, AND ATTEND EVENTS LISTED ON ARCH, AT YOUR OWN RISK.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, Arch AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR REPUTATION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (US $100).
Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the greatest extent permitted by law.
13. Indemnification
You agree to indemnify and hold Arch harmless from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law or any third-party right, or (d) any event you host on Arch.
14. Dispute resolution
14.1 Informal resolution first
Before filing any claim, you agree to first try to resolve the dispute informally by contacting support@arch.college and providing a written description of the dispute. We will try to resolve it within 30 days.
14.2 Binding arbitration
If we cannot resolve the dispute informally, any dispute, claim, or controversy arising out of or related to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Monmouth County, New Jersey, or by telephone or video conference at your option.
14.3 Class-action waiver
YOU AND ARCH AGREE TO BRING DISPUTES IN AN INDIVIDUAL CAPACITY ONLY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
14.4 Opt-out
You may opt out of Section 14 (Dispute Resolution) by emailing support@arch.college with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. Your opt-out will not affect any other provision of these Terms.
14.5 Exceptions
This section does not require arbitration of: (a) small-claims-court actions; (b) actions for temporary or injunctive relief; or (c) actions to enforce intellectual-property rights.
15. Governing law
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law principles. Subject to Section 14, the state and federal courts located in Monmouth County, New Jersey will have exclusive jurisdiction over any dispute not subject to arbitration.
16. Changes to these Terms
We may revise these Terms from time to time. Material changes will be announced in-app and via email at least 7 days before they take effect. Continued use of the Service after the effective date of the revised Terms constitutes your acceptance.
17. Miscellaneous
- Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Arch.
- Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
- No waiver. Failure to enforce a provision is not a waiver.
- Assignment. You may not assign your rights under these Terms. We may assign ours to a successor in a merger, acquisition, or sale.
- Apple-specific terms. If you obtain the Service through the Apple App Store, you acknowledge that these Terms are between you and Arch (not Apple), that Apple has no obligation to provide support for the Service, and that Apple is a third-party beneficiary of these Terms with the right to enforce them against you.
